Family petitions DPP over foul play in Entebbe land wrangle

A family in Entebbe has petitioned DPP Jane Frances Abodo complaining of what they termed as foul play in a matter where their land was encroached on and consequently grabbed by their neighbour.
Rosemary Kiiza Omamteker says in 2022 her land on plot 31A at Uringi Crescent, Busiro County, Entebbe in Wakiso District was encroached on by her neighbour, Peace Barigye and the matter ended up at police .

At police, cases of criminal trespass and malicious damage under CRB 447/2022, CRB 1070/ 2022 and CRB 703/2022 were reported against Barigye but to Omamtekerโs dismay, the files were allegedly mishandled by Entebbe Police leading to what she terms as miscarriage of justice.
To her shock, two years later after he files had been buried under the carpet, last year, Barigye lodged a counter complaint against Omamteker registered as CRB 850/2024 and was processed at supersonic speed .
Consequently, she was summoned to police to record a statement and later released on bond.
Meanwhile, dismayed by these actions, Omamteker says she sought interventionย from the DPPโs office and she was later sent to the regional state attorney at Nakawa, one Moses Onencanย who recommended further investigations, specifically advising both parties to engage a government surveyor to conduct a boundary opening to establish the party in the wrong.
โWe fully complied with this directive by writing to the commissioner surveys and mapping at the Ministry of Lands, Housing and Urban Development to carry out the said boundary opening to which a report was issued and submitted to police,โ Omamteker says.
The survey report
A copy of the survey report dated November, 19, 2024 and signed by Arthur Makanga, the surveyor from the Ministry of Lands, Housing and Urban Development and copied to both copies shows there was an encroachment by Plot 31B owned by Peace Barigye on Plot 31A owned by Omamteker.
โPlot 31B encroaches onto Plot 31A Uringi Crescent by a total area of 0.028 hectares( 0.071 acres). This is the area enclosed off by Plot 31B โs wall fence,โ the survey report says in part.
โ In conclusion, the boundary opening survey for Plots 31A and 31B Uringi Crescent was successful and clearly indicates some significant encroachments for the two plots.โ
However, Omamteker says to her shock, a few days after the survey report was released, she was informed that the files related to her complaints on CRB 447/2022, CRB 1070/ 2022 and CRB 703/2022 had suspiciously been closed by Annet Nabulobi, the state attorney in Entebbe and without any justification .
In contrast,ย the file on CRB 850/2024 of the case opened by Peace Barigye has remained active, to date.
โI believe the disparity in handing cases is malicious with serious an ulterior motive to subject me, myย daughter and workers to malicious prosecution. The other party has encroached on my land but the justice keepers are aiding her by having me and my family members arrested,โ Omameteker told journalists.

โWhen ministry did the survey, we thought everything is in black and white but we are perplexed by what has happened. We need assistance from the DPP Lady Jane Frances Abodo herself. We think there is foul play in this matter,โ Capt Omamteker said.
Contacted for a comment on the matter, the deputy public relations officer of the ODPP , Irene Nakimbugwe didnt pick repeated calls to her.
She also didnt respond to messages on the matter.
